Can an old eviction make it more difficult for me to enter a new lease?

My last landlord evicted me from the property, and now I'm looking for a new place. Can a future landlord refuse to rent to me because of the eviction? Yes. A landlord may refuse to rent to a tenant because of a prior eviction. The Texas Association of REALTORS® Residential Lease Application (TAR 2003) asks whether the applicant has ever been evicted. Furthermore, an eviction could include a judgment against a tenant for nonpayment of rent, which could negatively affect that tenant’s credit score. A poor credit score can also be grounds for denial of a lease applicant. While landlords can refuse to rent to a tenant based on a prior eviction or a poor credit score, they are not required to do so.

What happens if the loan won’t be processed by the closing date?

I’m buying a home, and the closing was supposed to be today. However, my lender says it’s going to take a few more days to process the loan. Since we had 30 days from the time we signed the contract until closing, I thought that would plenty of time. What happens now? This scenario has become more common recently, as federal regulations imposed by the Dodd Frank Wall Street Reform and Consumer Protection Act have made 30-day closings harder to complete on time than in the past. The contract does not include an automatic extension if the lender doesn’t process the loan by the closing date. As such, the seller could claim that you did not uphold your contractual obligations. However, since time is not of the essence to the closing date, you could argue that a few extra days is not a material breach of the contract. Alternatively, you and the seller may agree to amend the contract to provide more time for the lender to process the loan. It is important to remember that the seller must agree to amend the contract and may require additional earnest money as a condition of signing the amendment to extend closing. Given the challenges of meeting a 30-day time frame these days, buyers may want to consider allowing more than 30 days from the execution of a contract until closing.

Do I need my spouse’s signature to sell property I bought before marriage?

I bought a house as a single woman and have since gotten married. My husband and I want to sell the property now. Will he have to sign the contracts, too? Perhaps. Although a home you owned before marriage would generally be considered your separate property, your husband may have obtained certain homestead rights. Consult your attorney to find out if this is the case. To effectively deliver possession of the property to the new owner, your husband may need to sign the real estate contract, the deed, and possibly other documents, as if the home was his property, too.

What renters should do now before purchasing a property

If you’re a renter thinking about buying your first property, you can be proactive about buying before you even start your search. Here are three steps you can take toward homeownership without signing any paperwork. Try out a homeowner’s budget. Although you can’t predict all homeownership costs down to the last penny, you can get a rough estimate of how it will affect your budget. Consider how much you can afford, potential mortgage payment, your local property taxes, and repair costs you might want to consider as a homeowner. Remember, you won’t have a landlord to call when the dishwasher leaks. Check your credit report. Request a free credit report to find out what a lender would see. Can I trim my neighbor’s tree?

Branches from a tree in my neighbor’s yard hang over our shared fence. These branches hang low and block a walkway on the side of my garage. Can I trim the branches back to the property line? You have the right to remove the over-hanging branches, but that doesn’t mean you should run outside with your saw. If you damage the tree or violate any local ordinances regarding tree trimming and limb removal, you could find yourself liable for damages or facing fines. Start by talking to your neighbor about the branches, and get his agreement on how you’ll trim the tree. Also, check with your city about any restrictions on pruning trees.

SPI Environmental Health Services Department Earns State’s Top Honor

The City of South Padre Island Environmental Health Services Department (EHSD) garnered the top honor in Texas for its work in the area of food inspection and enforcement. At the November 12th City Council meeting, Mayor Barry Patel introduced Jodie Heilman-­‐ Halter, the Texas Environmental Health Association’s (TEHA) Executive Director, who recognized the department. EHSD was the only small jurisdiction in the state to earn the Texas Environmental Health Association’s (TEHA) Award of Excellence. The City’s EHSD Director Victor Baldovinos and Health Inspectors Cipriano Torres and Willie Higginbotham received the plaque honoring their achievement. “We are extremely honored and would like to share this award with our partners, including the City of South Padre Island City Council and the all the local restaurateurs,” said Baldovinos. “Without their continued support, this accomplishment would not be possible,” he further stated. TEHA is a state association that strives to protect and strengthen the status of the environmental health profession. The Award of Excellence recognizes entities throughout Texas that achieve a high degree of professionalism and commitment to the communities they serve.

Unofficial results revealed Rick Wells triumphant over Robert Vela for Position 1 due to a strong showing in South Padre Island and with mail-in ballot voters, and a surge in Port Isabel allowed Nancy Martinez to squeak out a narrow win over John Thobe for Position 2 by roughly 20 votes.

Do I have to disclose a repair I made last year?

I hired a licensed electrician last year to fix a wiring issue in my home. I’m putting my house on the market next week, and I know I’m supposed to disclose defects of the property. Since I had the wiring issue fixed, do I have to disclose it? No, you do not have to disclose a previous wiring repair. While you must disclose known defects or malfunctions of your property, the only previous repairs you must disclose are those to the foundation, roof, or other structural repairs, such as a collapsed overhang. Since the repair of the wiring issue is not one of these types of repairs, you do not have to disclose it. If you have made previous roof, foundation, or other structural repairs, you should disclose these items in Section 3 of the Texas Association of REALTORS® Seller’s Disclosure Notice. Section 4 is where you should disclose anything still in need of repair. Your Texas REALTOR® can provide more information about this form. While you’re not required to disclose this electrical repair, keep in mind that it’s always better to disclose too much than too little. You’ll reduce your risk of facing future problems if you’re up front and honest in your disclosures.

How to Save Energy in Your Home Fall is upon us and in the months generally known for colder weather, keeping our homes warm is a top priority. Even in those geographic regions where the mercury doesn't drop below 50, knowing your home is not losing energy is a relief when you spend your hard earned dollars keeping your home warm or cool. Saving energy in your home is not a difficult process. There are many easy free and low-cost ways to save energy and money on your heating and cooling bills. Listed below are some steps you can take in your home to help conserve energy and save yourself some money in the process: Install A Programmable Thermostat:
Heating and cooling your home uses more energy and costs you more money than any other area or system in your home. Heating and cooling makes up almost half of your utility bill, so knowing how to eliminate energy waste when it comes to heating and cooling will save you money each month. By installing a programmable thermostat you help to automatically adjust your home's temperature to when you've programmed, which helps it stay warm (or cool) when you need it to be. Seal Air Leaks: A home is rarely air tight, and checking for air leaks is a great way of determining where warm or cool air could be escaping and adding money on to your energy bill. There are a number of areas where air escapes: windows, doors, electrical boxes, ceiling fixtures, attics and more. You can help reduce or eliminate leaks by caulking and/or weather-stripping doors and windows, installing foam gaskets behind outlets and switch plates, or using foam sealant on larger gaps around windows and baseboards. Taking the time to find air leaks and fix them will help save you money and keep your home warm or cool. Improve Insulation: Heating and cooling make up the majority of your energy bill, over 50 percent, so knowing your home is insulated properly can help keep your home warm in the winter and cool in the summer. Checking the insulation in your home's attic, walls, floors, and ceilings will tell you how much air is flowing between the inside and outside of your home and help you determine the best way of controlling the temperature inside. One important place to look for insulation is your attic – a well-insulated attic can help slash your heating and cooling bills in both the winter and summer months by helping to maintain indoor temperatures and seal air leaks through your roof. Install Efficient Windows: Window glass is not known for being very thick, and single-pane windows are notorious energy loss culprits. One option is to replace current windows with storm windows. Storm windows "reduce temperature loss by sealing leaks and creating a dead airspace between window panes" (motherearthnews.com). Storm windows can be expensive, but their return on investment is about 10 years, which is relatively short. Another option, if installing new windows is not feasible, is to cover windows with transparent material to help improve insulation. This site has great techniques on conserving energy in your home by implementing winter window treatments. Conserve Water:
Using less water benefits you, your water bill and the environment. When you use less water, you also use less energy needed to heat the water. The Department of Energy lists water heating as the third most energy consuming function in a home. To help conserve water, you can take shorter showers and be conscious of the water used when washing dishes, food and clothes. When running the dishwasher or the washing machine, make sure the machine is filled to capacity to save water and energy on extra washes. You can also save energy by lowering the temperature on your hot water heater. The Department of Energy says 120 degrees is sufficient for most household uses. You can also save water and money by installing water-efficient fixtures and appliances throughout your home. Turn Off Electronic Devices: Do you leave your coffee maker plugged in when not using it? According to the US Department of Energy, "In an average home, 75 perfect of the electricity used to power home electronics is consumed while the products are turned off." This is called a "phantom load," or the energy appliances or electronics use when not turned on. You can minimize phantom loads and save on your energy bill by unplugging appliances and electronics when not in use, or plugging them into a power strip and turning the strip off when not using the appliances or electronics Change Out Light Bulbs:
One cost-effective technique for saving energy and money is replacing the traditional incandescent light bulbs in your home. There are a number of options available that will help you save energy, and some offer longer life and greater savings than others. From halogen incandescent bulbs, to compact fluorescent lamps (CFLs), to light-emitting diodes (LEDs), each bulb has its benefits. Halogen incandescent bulbs are energy-efficient incandescent bulbs and can last up to three times longer than traditional incandescent bulbs. CFLs last up to 10 times longer than traditional incandescent bulbs and are extremely affordable. LEDs are becoming more and more popular and their prices have significantly dropped in recent years. LEDs use 20%-25% of the energy traditional incandescent bulbs use, and LEDS can last up to 25 times longer, some even being touted to last up to 25 years. You also have the option of performing a home energy audit. An energy audit, also known as a home energy assessment, assesses how much energy your home consumes and helps you evaluate the best measures you can take to make your home more energy efficient. There are a number of options for home energy audits, from Do-It-Yourself audits, to professional audits that include blower door tests, thermographic inspections and PFT air infiltration measurements. Why is my house being sold all over the Internet?

I signed an agreement with one real estate broker to sell my house. But now my house is not only on his company’s website—it’s showing up for sale on a bunch of other websites, too. What gives? Maximum exposure for a home is a good thing. The more people who know your home is for sale, the better your chances of finding a buyer. “Casting a wide net” may help you find a buyer sooner, sell your house for more money—possibly even create a situation with multiple buyers competing to purchase your home. And there’s no wider net than the Internet. Most brokers have agreements and systems in place to display listings on a variety of websites, including other local brokerages and national listing portals, like realtor.com and texasrealestate.com. Look at your listing agreement. If it’s the Residential Real Estate Listing Agreement Exclusive Right to Sell from the Texas Association of REALTORS®, you’ll see in Paragraph 11 (Broker’s Authority) that it authorizes the broker to display the property on the Internet without limitation unless one of the following sections is checked. If you’d like to restrict display of your property, talk with your broker. Just realize, though, that you’ll be limiting the number of potential buyers who know that your house is on the market.

Hey, Internet, why are you such a tease?

I admit it … I got sucked in. I was poking around on Zillow when a photo of a beautiful bathroom caught my attention. A little tag at the top said, “Estimate: $15,500.” Wow! I was instantly transported to daydream mode, imagining this stunning bathroom in my home. Then, like a needle scratching across a record, a user comment below the photo jerked me back to reality. “Lots o’ luck,” said this person, identifying him or herself as a remodeling professional. The remodeler projected that the cost was off by at least 100%. Another commenter pegged the price at about $60,000. Daydream over. I should’ve known better. Zillow is an interesting website. But I know their “zestimates” for home values are all over the place, often wrong by 20% or more. I’ve seen them designate the University of Texas as a nearby neighborhood to Lakeway. (Hey, it’s only about a seven-hour walk!) Still, for a second there, I thought I could update my 1960s-era bathroom into a modern dream bathroom for a quarter of the real cost. In the future, if I want to know what a bathroom remodel will set me back, I’ll ask a contractor. Just like when I’m ready to sell my home and want to know what it’s worth—or I’m looking to buy and need to know if one neighborhood is near another—I’ll contact an expert who really knows what's going on ... Evans, arriving with her husband and looking relaxed and happy, had a frightening moment briefly before the festivities began; a short choking fit had attendees momentarily alarmed, but she recovered after a few minutes with a little assistance and some water.

Booming mosquito population prompts spraying

Mosquito crane-flyIn the ongoing war against mosquitoes, local communities have struck a critical blow against the blood-thirsty pests. Adrian Rodriguez, public information officer for the City of South Padre Island, said the Island is spraying “every morning at 4 a.m.” and in the evenings “whenever the wind isn’t blowing.” Rodriguez explained that strong winds would simply blow the spray right off the Island. A press release issued by the City of SPI reads, “Due to recent heavy rains, the South Padre Island Environmental Health Services Department (EHSD) larvicided standing water on the entire Island.”

A LANDMARK RESTORED: Grant paves way for hotel

Congressman Filemon Vela (D-Brownsville) along with U.S. Economic Development Administration (EDA) Regional Director Pedro Garza announced a $1.2 million grant for the acquisition and renovation of the Yacht Club Hotel in Port Isabel. The announcement came Wednesday, Oct. 8. The Yacht Club Hotel on North Yturria Street is the future site of the Culinary Arts Institute of Port Isabel. According to a press release issued by the office of Congressman Vela, “The EDA grant will support the re-purposing of the Yacht Club Hotel and restore the landmark to its original state.

Will my soon-to-be-ex-spouse have to sign the contracts, too?

My wife and I bought a house together a few years ago, and now we’re getting divorced. Neither of us wants to keep the house, so we’ve agreed to hire a real estate broker to list the property. Will we both have to sign the contract to work with the broker? Would we both have to sign to accept an offer? Most likely, yes to both questions. Assuming both you and your wife own the property, any real estate broker will need authorization from both of you to market and sell the property. A signed listing agreement between both of you and the real estate broker will provide the necessary authorization. Additionally, any offer to purchase the property will need to be signed by both of you in order to be considered accepted. Keep in mind that if divorce proceedings have already been initiated, you will need to inform your attorneys, if any, about the plans to sell the property so that they can obtain any necessary authorization from the divorce court.

5 tips to hire the right moving company

It’s a great feeling when you've found the property of your dreams. It’s not such a great feeling to start planning how you’ll move your belongings into it. Hiring movers can help you take some of the stress out of your move, but only if you find the right one. In addition to review and ratings websites, word-of-mouth recommendations are a good way to identify your options. Your Texas Realtor is another great resource for learning about reputable movers in your area. Once you have a few companies in mind, narrow down the competition with these tips. Three is the magic number Choosing one company without doing your research could lead to a frustrating experience, but calling a dozen moving companies for estimates can take too much time. Instead, decide on at least three companies you want to learn more about. You’ll get a good sense for average rates and offerings for your area. You may even be able to use their estimates to your advantage later. Get an in-person assessment Most people aren’t a good judge of how much stuff they have, and while some companies have online tools that create an estimate using your best guess, you should ask your picks to visit your home and take inventory for an accurate estimate. During an in-person assessment, you’ll be asked about what you’re planning to take, the moving supplies you need, and about your heavy or fragile items. Your movers will need to know the layout of your new property, too, so don’t forget to tell them about the three flights of stairs or that they’ll have to park on the street. Ask questions There are plenty of questions you can ask depending on your situation, but make sure to get answers to these in particular: Are you licensed for in- or out-of-state moves? The Texas Department of Motor Vehicles licenses moving companies, which must have an active TxDMV certificate on file to operate legally. Find out if a company is licensed at apps.txdmv.gov/apps/mccs/truckstop. What type of insurance do you carry? (They should at least carry workers’ compensation insurance.) What insurance coverage do you offer for my belongings? (valuation or replacement coverage) Can I pack myself? Will my items be covered if so? Is your crew bonded? (protection in case of employee theft, vandalism) Are there items you won’t transport? (light bulbs, batteries, gas) Don’t hold back information Be upfront about what you need your movers to do, whether it’s packing and unloading, assembling or dissembling items, or heavy lifting. You may think you can get a deal by glossing over details, but you’ll ultimately pay more for your hidden extras, and your movers won’t be pleased. Negotiate the deal You’ll receive an estimate from your moving companies based on several factors, such as the distance of the move and the potential gas expense, the weight or square footage that your items will use in the moving van, and labor costs. This is where having more than one estimate will come in handy. Don’t be afraid to tell your top pick if you’ve received a lower estimate that appeals to you, or roughly how much you want to spend. Look for other areas in which you can negotiate, such as free junk-hauling services or reduced rates for extra supplies or a different move date. Your movers can be a huge help, but only if you put in the effort to choose the right one.

SALES TAX REPORT: South Padre Island, Port Isabel collections increase in July

The cities of Port Isabel and South Padre Island experienced an increase in sales tax receipts collected in the month of July. According to data reported by the Texas Comptroller’s Office, which tracks and reports sales tax information two months prior, Port Isabel reported a 2.77 percent rise in collections in July – from $225,976.59 in 2013 to $232,244.39 this year. This is up from Port Isabel’s 2.72 percent decline in sales tax collections reported during the month of June.

What some sellers know that others don’t

Another For Sale By Owner sign popped up in my neighborhood recently. I wonder if the sellers are heading down the same path as the last three homeowners who tried to go FSBO. Here's what happened for each of them: A sign went up in the yard—the familiar red and white FSBO sign for two of the homes and a homemade poster board on a wooden stake for the third. All had hand-written phone numbers scrawled on them ... not easy to read. There were property fliers, an open house or two, and then ... nothing. After a month or more, all three signs were replaced with signs of Texas REALTORS®. And guess what happened next? All three properties sold, one in just two days and the others in a little over a week. Now, I'm not saying that people can't successfully sell their homes themselves. But I will tell you that plenty of people learn the hard way that it's not as easy as jamming a sign into your yard. A Texas REALTOR® not only will bring more attention to your home but can help you price it, give you advice about buyers' offers, help you negotiate, and assist with the dozens of tasks between a contract and a successful sale. Something to think about if you're considering selling on your own.

If you’re thinking of buying property, you’ll probably apply for a mortgage. But before lenders decide what they’re willing to offer you, they’ll want some financial background, such as your employment history, salary, bank-account balances, and your credit history.
Know your status before a lender does 
While you could wait to find out how your financial picture appears to lenders after they’ve decided whether to loan you money, you’d be better off finding out first. One way is to request a free credit report so you can see what a lender might see.
What is a credit report? 
A credit report shows how much you borrow, whether you pay on time, or if you’ve been sued or declared bankruptcy. A credit report is not the same as a credit score. It usually costs money to find out what your credit score is, and can vary depending on the source you obtain it from.
How do you get a free credit report? 
You can request one free credit report every 12 months from each of the three major consumer credit-reporting agencies: Equifax, Experian and 
TransUnion. But you don’t have to get all three reports at once. Obtaining one report at time, like quarterly, can help you monitor changes and is a good way to find out if you’ve become a victim of identity theft.
How does your credit report help you buy a house? 
A credit report gives you insights into your financial habits. For example, you’ll see how well you do at paying debts on time and if you tend to borrow within your means. Checking your credit report now also gives you a chance to find errors, which you can correct before they affect your ability to qualify for a mortgage loan. And if you find legitimate flaws, you might be able to take steps to improve your credit standing before purchasing a property.
